SWAN STORIES CAMPAIGN

Terms and Conditions

THIS IS NOT A CONTEST AND THERE IS NO PRIZE

One Jeanswear Group LLC (“OJG”) wants to know your Gloria Vanderbilt® Jeans story. After 50 years of Gloria Vanderbilt® Jeans, we want to celebrate with YOU. Whether you wore your Gloria Vanderbilt® Jeans on a first date, saved up for them as a teenager, or have 10 pairs of Amanda® jeans in your closet, OJG wants to hear your Gloria Vanderbilt® Swan Story. We are holding this casting call to help us choose Models (as defined below in Section 5) who may be given the opportunity to come participate in a photo shoot in New York, New York (the “Shoot”), and who may be cast as one of the faces of the Swan Story campaign (the “Campaign”).

1. Eligibility. The “Swan Story Casting Call” (“Casting Call”) is open to legal residents of the continental United States, who are at least 18 years of age or older as of the date of his or her Submission. Participants hereby fully agree to comply with these Terms and Conditions (“Terms”) in all aspects of this Casting Call and the related Campaign (defined below). To preserve the integrity of the submission and/or selection process, OJG may modify the submission and/or selection process, as well as the submission period, in its absolute and sole discretion, and has the right to cancel the Casting Call and materially modify these Terms, in its absolute and sole discretion.

The Casting Call is governed by U.S. law, and specifically the laws of the State of New York. Participants may not enter if any applicable laws, rules or regulations would prohibit their participation in this Casting Call. Eligibility to be selected for the Casting Call and Shoot is contingent upon complying with and fulfilling all requirements set forth herein. By participating in the Casting Call, participants agree fully and unconditionally to these Terms and OJG’s decisions, which are final and binding in all matters related to the Casting Call.

PARTICIPATION IN THE CASTING CALL ONLY PROVIDES AN OPPORTUNITY FOR PARTICIPANTS TO BE CONSIDERED FOR PARTICIPATION IN THE SHOOT AND POSSIBLE USE IN AN ADVERTISING CAMPAIGN FOR OJG. THIS CASTING CALL DOES NOT GUARANTEE THAT ANY PARTICIPANT WILL BE INVITED TO PARTICIPATE IN THE SHOOT OR APPEAR IN THE CAMPAIGN. PARTICIPANTS UNDERSTAND AND AGREE THAT OJG HAS THE RIGHT TO SELECT ANY PERSON OR PARTICIPANT IT CHOOSES TO SELECT (OR NO PERSON OR PARTICIPANT IF IT CHOOSES TO DO SO) TO APPEAR IN THE SHOOT AND THE CAMPAIGN.

2. How to Apply. To apply for the Casting Call, during the Casting Period (defined below), participants must access the application through the following link https://gloria-vanderbilt.com/pages/swan-stories-submissions and share their Swan Story (as described in more detail below) (“Swan Story”). Participant’s Swan Story should showcase the participant’s connection with, and affinity for, Gloria Vanderbilt® Jeans (the “Theme”).

All submission information, including the Swan Story, participant’s name, and any other material included in the application shall be collectively referred to herein as the “Submissions” or each as a “Submission.” Submissions must comply with the Content Guidelines and Restrictions defined below in Section 4. No other method of participation will be accepted. Submissions that do not follow these Terms may be disqualified at OJG’s discretion.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE IN THE CASTING CALL.

By applying, each participant warrants and represents the following with respect to his/her Submission: (a) participant is the sole and exclusive owner of the Submission; (b) the Submission will not infringe on any rights of any third parties; (c) any third parties appearing or referenced in the Submission have given the participant appropriate consent to be referenced and used as permitted herein; and (d) this Casting Call does not conflict with any existing commitments on participant’s part nor does it violate any third party rights and/or agreements. OJG reserves the right to request releases from any third parties appearing or referenced in any Submissions at any time. Failure to produce third party releases upon OJG’s request may render the participant ineligible for consideration in the Casting Call, as determined by OJG in its sole and absolute discretion.

Limit one (1) Submission per person. Duplicate Submissions will not be given consideration. All terms and conditions of gloria-vanderbilt.com apply. Any attempt by a participant to make multiple Submissions by using multiple/different accounts, identities, or any other methods will be invalid and that participant may be disqualified from consideration in the Casting Call. Use of any automated system to participate is prohibited and will result in disqualification. OJG is not responsible for lost, late, incomplete, invalid, unintelligible, misdirected or technically corrupted Submissions, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed and received Submissions are eligible. Receipt of Submissions will not be acknowledged and proof of submission will not be deemed to be proof of receipt by OJG.

3. Start/End Dates. Casting begins at 12:00:00 PM Eastern Time (“ET”) on Tuesday, May 19th, 2026 and ends at 11:59:00 PM ET on Saturday, June 6th, 2026 (“Submission Period”).

4. Content Guidelines and Restrictions:
By participating in this Casting Call, each participant agrees that his or her Submission conforms to the Content Guidelines and Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that OJG, in its sole discretion, may ignore any Submission and disqualify a participant from consideration in the Casting Call if it believes, in its sole discretion, that the Submission fails to conform to these Guidelines and Restrictions.

Content Guidelines and Restrictions:

  • The Submission must not contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights;
  • The Submission must not disparage OJG, Gloria Vanderbilt, or any other person or party;
  • The Submission must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;
  • The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
  • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the jurisdiction where the Submission is created;
  • The Submission must be consistent with the image and values of OJG and the Gloria Vanderbilt® brand and be consistent with and satisfy the Theme of the Casting Call.

5. Casting Selection and Shoot Details. At the conclusion of the Submission Period, eligible Submissions will be reviewed by OJG and selected participants will be invited to meet with certain OJG personnel to learn more about the participant and their Swan Story. Once OJG has met with all selected participants, OJG will select certain participants (individually a “Selected Model” and collectively the “Selected Models”) to attend and participate in the Shoot taking place in New York, New York, currently scheduled for mid-July 2026, but subject to change or cancellation in OJG’s sole discretion.

Selected Models will be selected by OJG based on how their Swan Story and Submission reflects OJG’s and Gloria Vanderbilt®’s brand image and Theme, as well as who would likely be the best representative for OJG’s and Gloria Vanderbilt®’s brand image and Theme. The Selected Models will be notified of their selection as described in Section 6 below.

Selected Models may be selected by OJG to potentially appear in OJG’s advertising campaign for Gloria Vanderbilt® Jeans. OJG shall have the right, but not the obligation, to use the Selected Models to appear in the Campaign advertising. The Campaign advertising materials featuring the Selected Models can be used globally, in perpetuity.

IN ORDER TO PARTICIPATE IN THE SHOOT, EACH SELECTED MODEL WILL BE REQUIRED TO SIGN OJG’S AGREEMENT, WHICH SHALL INCLUDE, AMONG OTHER THINGS, A (i) PUBLICITY RELEASE, (ii) CONFIDENTIALITY AND NON-DISCLOSURE AGREEMENT, AND (iii) ANY OTHER DOCUMENTS REQUESTED BY OJG IN OJG’S SOLE DISCRETION (COLLECTIVELY, “CASTING CALL DOCUMENTS DOCUMENTS”). If any potential Selected Model fails or refuses to sign and return all Casting Call Documents within seventy-two (72) hours following notification, the Selected Model may be disqualified, and an alternate Selected Model may be selected.

All decisions of OJG with respect to casting, this process and any other matter are final and will be made in the sole and absolute discretion of OJG. Nothing shall obligate OJG or its advertising and promotion agencies, or any of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “OJG Parties”) to include any Selected Model in the Campaign or make use of any of the rights set forth herein.

OJG will provide each Selected Model with: (i) round-trip coach airfare between the major airport that is nearest to the Selected Model’s residence and the Shoot location in New York, or other location as determined by OJG at its sole discretion; and (ii) reasonable hotel accommodations for the duration of the Shoot at a hotel selected by OJG in its sole discretion. If a Selected Model’s residence is close enough to New York such that air transportation is deemed by OJG in its sole discretion to be unnecessary, OJG will provide railway or alternative ground transportation in lieu of air transportation for such Selected Model, and no other substitution or payment will be provided. All travel arrangements (including airfare and hotel arrangements and departure and return dates) will be made by OJG in its sole discretion. The Selected Models must possess all required travel and work documents, including visas and valid passports, if and as applicable. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Other travel restrictions and blackout dates may apply. All airline tickets and other travel arrangements are subject to the vagaries of flight and trip variation, work stoppages, and schedule or route changes. Other hotel fees may not be included and if applicable may be payable at the time of check-out by the Selected Model. A deposit or payment in advance, or presentation of a credit card by the Selected Models, may be required by the hotel at the time of check-in. Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the Selected Models are solely responsible for any charges and/or fees arising from changes made directly with the hotel. The restrictions and conditions stated herein are not all-inclusive and the Shoot may be subject to additional restrictions and conditions, which may be stated in travel or other documents.

In the event any Selected Model engages in behavior that, as determined by OJG in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, OJG reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the Selected Model home with no further compensation. If a Selected Model does not or cannot participate in the Shoot due to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, such Selected Model may be disqualified and an alternate participant may be selected. Each Selected Model’s schedule during the Shoot will be entirely at OJG’s discretion and is subject to change without notice.

Each Selected Model must verify his or her identity via photo ID and his or her legal right to work in the United States in advance of the Shoot. If a Selected Model lacks or fails to provide such verification, he or she may be disqualified from the Casting Call and an alternative Selected Model may be selected.

THERE IS NO GUARANTEE THAT A SELECTED MODEL WILL RECEIVE ANYTHING OTHER THAN THE RIGHT TO PARTICIPATE IN THE SHOOT, AND ALL PARTICIPANTS EXPRESSLY ACKNOWLEDGE THAT BEING SELECTED TO PARTICIPATE IN THE SHOOT DOES NOT ENSURE ANY SELECTED MODEL WILL BE A PART OF THE CAMPAIGN OR IN ANY OTHER WAY BE INVOLVED IN OR ASSOCIATED WITH OJG OR THE GLORIA VANDERBILT® BRAND. OJG RESERVES THE RIGHT TO NOT USE ANY OF THE SELECTED MODELS IN ANY CAMPAIGN AND MAY INSTEAD USE SOMEONE WHO DID NOT PARTICIPATE IN THIS CASTING CALL OR THE SHOOT.

6. Notification. OJG will notify each potential Selected Model by e-mail, which shall include OJG’s contact information and instructions for the potential Selected Model to respond. Potential Selected Models will only be contacted by an email address ending in “@ojg.com”. The potential Selected Model must respond to OJG using that contact information within seventy-two (72) hours of notification. OJG shall have no liability for any selection notification that is lost, intercepted or not received by a potential Selected Model for any reason. If a potential Selected Model does not respond within seventy-two (72) hours of the notification attempt, or if the notification is returned as unclaimed or undeliverable to such potential Selected Model, such potential Selected Model will forfeit his or her participation in the Shoot and an alternate Selected Model may be selected. If any potential Selected Model is found to be ineligible, or if he or she has not complied with these Terms or declines for any reason prior to the Shoot, such potential Selected Model will be disqualified and an alternate participant may (but is not required to) be selected. OJG may rescind any such selection or notification at any time, with or without cause.

7. Grant of Rights. Each participant hereby grants to OJG an irrevocable, nonexclusive, royalty free license to reproduce, distribute, modify and otherwise use in any manner his or her Submissions. All Submissions or other materials and personal information submitted by participants may be shared by and between all parents, affiliates, and subsidiaries of OJG. By participating in the Casting Call, each participant hereby agrees to OJG’s collection and usage of any personal information included in his or her Submission and to notify participants about OJG news and information for promotional purposes, all in accordance with OJG’s privacy policy at https://gloria-vanderbilt.com/pages/privacy-policy-fa24. By participating in the Casting Call, participants acknowledge that they have read and accepted OJG’s privacy policy.

8. Release. By participating in the Casting Call, each participant agrees to release and hold harmless OJG, and its respective subsidiaries, affiliates, suppliers, distributors, and advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, members, managers, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Casting Call, the Shoot and/or the Campaign, and/or the selection or non-selection of each participant, including without limitation (i) any condition caused by events beyond the Released Parties’ control that may cause the Casting Call or Shoot to be disrupted, postponed or cancelled; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of participation in the Casting Call or the Shoot other than those caused by the negligence or intentional misconduct of a Released Party; and (iii) any printing or typographical errors in any materials associated with the Casting Call.

9. Limitation of Liability. The Released Parties are not responsible for (i) late, lost, delayed, damaged, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of entry materials; or (iii) phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures or difficulties. The selection of Selected Models to participate in the Shoot is provided “as is, where is,” without warranty of any kind, express or implied.

IN NO EVENT WILL ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE CASTING CALL, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY IN CERTAIN CIRCUMSTANCES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO ALL PARTICIPANTS. TO THE EXTENT ANY LIMITATIONS OR EXCLUSIONS TO LIABILITY DESCRIBED ABOVE ARE NOT PERMISSIBLE IN A PARTICIPANT’S JURISDICTION, SUCH LIMITATIONS AND/OR EXCLUSIONS WILL BE DEEMED MODIFIED TO COMPLY WITH THE APPLICABLE LAWS, RULES OR REGULATIONS IN SUCH JURISDICTION.

10. Disputes; Governing Law; Jurisdiction. Any controversy or claim arising out of or relating to these Terms and/or the Casting Call shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the United States, within the State of New York, City of New York. For any matters which are not subject to arbitration as set forth in these Terms and/or in connection with the entering of any judgment on an arbitration award in connection with these Terms and/or the Casting Call, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to New York County in the State of New York. The parties agree not to raise the defense of forum non conveniens.

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE TERMS OR THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS OR OJG IN CONNECTION WITH THE CASTING CALL SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE UNITED STATES IN THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

11. No Obligation to Use. OJG shall have no obligation (express or implied) to use any Submission or any materials or content created by any participant (collectively, the “Materials”), select any Selected Models, or to otherwise exploit any Submission or Materials or, if commenced, to continue the distribution or exploitation thereof, and OJG may at any time abandon the use of the Submission or Materials for any reason, with or without legal justification or excuse, and participants shall not be entitled to any damages or other relief by reason thereof.

Without limiting any other provision in these Terms, in the event that any of the participants’ activities or the Released Parties’ operations or activities are affected for reasons outside of their control, as determined by OJG in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, pandemic or public health crisis, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above, subject to any governmental approval that may be required, OJG shall have the right to modify, suspend, or terminate the Casting Call, and no Released Party shall be responsible or liable to any participant or Selected Model or any person claiming through such participant or Selected Model for failure to hold the Shoot. OJG is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in participant’s e-mail account to receive e-mail messages.
